Welcome to Silicon Beach USA, reporting on the actions and consequences of hapless government officials, elected and appointed, doing their doody on the sands of the Pinellas Gulf Beaches.

Unfortunately, cleaning up costs Pinellas Beach taxpayers more and more and delivers less and less.

Serious citizen movements are growing to dislodge the root cause of these problems: a quarter-century-plus of "old-boys/old-gals" networks of many elected and many appointed representatives and servants of the people.

They just don't get it. Why was the recent Pinellas Assembly such a failure? You'll get completely different answers from County reps and the rest of us. They really don't get it.

Content for this site is accepted from citizens (okay, we include the government types, too, who want to respond) about the foibles and faux paux in government that drive us crazy and drive up taxes.

The following is Title 17, Section 107 of the United States Law code.

Sec. 107. Limitations on exclusive rights: Fair use

In determining whether the use made of a work in any particular case is a fair use, the factors to be considered shall include - (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; (2) the nature of the copyrighted work; (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and (4) the effect of the use upon the potential market for or value of the copyrighted work. The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

SiliconBeachUSA maintains the fact that its usage of copyrighted material was, is and will be completely legal. Under heading one (1) above, it is clearly stated that a County or City's status as either for profit or nonprofit should be taken into consideration. Because SiliconBeachUSA does not charge for its Content, it should be considered for all legal purposes to be nonprofit. Even if we charged for content or accepted contributions, it would be so cheap as to remain nonprofit.

Number three (3) states that "the amount" of the copyrighted material used should be taken into consideration. Under no circumstances has SiliconBeachUSA or will SiliconBeachUSA use a significant piece of any copyrighted material. To this point it has limited its use to parts of copyrighted materials including, but not limited to, articles, public documents and songs.

Finally, Number four (4) states that the "effect" that the usage of the copyrighted material has upon that material's success should be taken into consideration. Because SiliconBeachUSA is substantially less known than the Counties, Cities and other entities which produce or stimulate the copyrighted materials used by SiliconBeachUSA, SiliconBeachUSA maintains that it has little or no impact on the success of those Counties, Cities and other entities.
